Breach of Fiduciary Claim Against Broker May Proceed

Here’s the first video blog clip. We’re discussing an opinion from the Eastern District of New York as printed in the New York Law Journal of September 3, 2008. The defendant’s have moved for dismissal of a complaint alleging breach of fiduciary duty against their agent, a reverse mortgage broker. As discussed in the opinion, the court finds sufficient indicators that the broker’s conduct may have risen to that of a fiduciary.
